    2. The Prime Minister felt strange, when the MACC investigated and prosecuted the "Super Rich", the opposition is silent.

    3. Who embezzled the forest concession area fund? Boyce Ngau Anyie urged the Sarawak state government to be transparent in handling the fund and use the money accumulated over the past 40 years to build roads to the interior and stop logging now.

    4. The value of the ringgit will strengthen again in the second quarter of 2024. The ringgit is expected to stabilize at RM4.50 against 1 US dollar.

Boyce Ngau Anyie, Vice Chairman Gerenai Community Right Action Committee (GCRAC)

*Where are the PROFIT of logging all this time, why are they not used to build roads to the interior?*

In conjunction with the current school holidays, Boyce who is a retired teacher brought his family and grandchildren back to Long Selawan village in Ulu Baram.

What's sad is that many of the log roads have been damaged and are difficult to pass. The 200km journey takes seven hours to reach the village. Residents hire bulldozers to repair the road. The road is a log haulage road by the Samling company. Because Samling has not been operating in this area since a year ago, so the road has been damaged a lot.

Does this show that the rural population still needs Samling to return to logging? Not at all- said Boyce. This proves the failure of Samling and the government. The government told us that logging would bring progress. What progress have we made?

In 1985, the Sarawak government established the Forest Concession Area Fund to collect logging revenue to be used for the advancement of communities involved in logging areas. The question is, where will the revenue collected for the past 40 years be spent? Why is there no explanation and financial presentation of this fund and he doesn’t believe GPS will make a difference.

Logging should be stopped 100% because it has failed to bring progress to the rural population and it is the responsibility of the central and state governments to build roads and progress for the people in the interior. Boyce urge the state government to be transparent about the management of this Fund.

*Emphasizing Edible Agriculture Development Over Destructive Palm Oil Land Use*

Last week, Lord Jonathan Peter Marland, Chairman of the Commonwealth Enterprise and Investment Council (CEIC), commended Sarawak's commitment to the green economy. However, he emphasized the need for the state to enhance its food security measures. Despite Sarawak's achievements in energy security and youth employment, Marland believes that addressing food security is crucial.

In response to Marland's remarks, Diog Dios expressed concern over the Sarawak government's efforts regarding food security. He noted that while Sarawak has vast land suitable for agriculture, the government has focused more on promoting oil palm plantations rather than food agriculture. Dios emphasized that oil palm plantations do not contribute to food security, yet the government has not educated the public about this issue.

Dios further criticized the government for not providing sufficient training and resources to farmers, especially those in inland areas. He revealed instances where agricultural fertilizers, seemingly provided by the government, were significantly reduced in quantity by the time they reached farmers, suggesting corruption in the distribution process. He called for tighter controls and supervision in the distribution process.

In light of these concerns, it is imperative for the Sarawak government to study more effective and efficient methods for distributing agricultural assistance to ensure it reaches farmers. Additionally, the government should focus more on food safety and strengthen agriculture by providing comprehensive assistance to farmers, enabling them to modernize and increase productivity. Improving agricultural infrastructure and supporting farmers in establishing cooperatives and produce collection centers can also enhance food security and the livelihoods of farmers. These efforts, combined with enhanced training programs, can help modernize farming methods and ensure a secure future for Sarawak's agriculture sector.

*Empowering B40 Traders: Promoting Economic Sustainability*

As the fasting month approaches, concerns about the high costs during this period are mounting, particularly among Bazaar Ramadan traders, many of whom are from the B40 group. These traders rely on the season to earn extra income for Hari Raya, making it a crucial time for their livelihoods.

In Kuching, where there are 26 premises for Bazaar Ramadan, some traders operate from home to reduce costs, albeit while ensuring compliance with SOPs. However, more needs to be done to alleviate the financial burden on these traders, especially given the economic challenges faced by many during this time.

MUDA has put forward four recommendations for enforcement and local authorities to address these issues effectively:

    1. Provide free space and permits: Offering free or subsidized rental spaces and permits can significantly reduce the financial strain on Bazaar Ramadan traders.

    2. Subsidize local products: Supporting local products through campaigns and subsidies can make them more affordable for both traders and consumers, boosting sales and income.

    3. Subsidize equipment and booths: Providing subsidies for essential equipment and booths can lower the barrier to entry for traders, enabling more individuals to participate in the Bazaar Ramadan.

    4. Collaborate with food delivery companies: Partnering with food delivery companies, such as Ketek in Kuching, can help traders reach a broader customer base and increase sales.

It is crucial for the GPS government, to take these recommendations seriously and implement them effectively. By doing so, they can alleviate the financial burden on Bazaar Ramadan traders, support local businesses, and ensure a more prosperous Ramadan for all.

    3. Sarawak Premier Abang Johari will continue Taib Mahmud's economic and administrative policies. In fact, according to John Brian, Johari will be even more greedy by manipulating hydrogen trading and carbon trading. This policy will only change with the defeat of GPS.

    ----------------------------

John Brian Anthony, Sarawak political analyst

*Abang Johari Will Plunder Indigenous Customs More Greedily Than Taib*

Journalist Marian Mokhtar wrote in Free Malaysia Today by raising the question - in the absence of Taib Mahmud, will the policy of the Sarawak government led by Johari Openg change and recognize the rights of the indigenous people of Sarawak to land and forests?

John Brian thinks that Taib Mahmud's policy will be continued by Premier Johari Openg and will even be more greedy. According to John Brian, why is that? Because the economic and administrative model founded by Taib brings profit to the government and can control the resistance of the subordinates. The people remain poor and the capitalists who get contracts and projects will donate money to the ruling political party to stay in power. The Fascist economic and administrative model created by Taib is strictly coupled with the exploration of the hydrogen energy industry and carbon trading. This will also take away the forest and land of the indigenous people.

Asked what is the attitude of the opposition party in Sarawak? The opposition parties should unite and formulate an economic model that is more favorable to the people. The way is to restore the people's rights to land and forests through amendments to Sarawak's land code and give shares to the indigenous population in every land, forest and sea exploration. The companies that have been granted PL must give shares to the people who own land in the area and after the expiry of the PL period. Land and forests should be returned to the original owners.

John believes that only with a clear explanation of the pro-people economic and administrative model will he be able to convince the people and thus the people will reject GPS in the upcoming elections.

*Challenges in Gas Cylinder Exchange: Rural Residents Left Struggling*

Jimmy and Akik Migi tells RFS that they facing the problem of exchange yellow gas cylinders for green ones throughout the Sarikei market, because the traders no longer accept yellow cylinders.

What is disappointing is that Akik Migi, who only has one yellow gas cylinder, has to use firewood for cooking because he cannot afford to have 2 LPG gas cylinders. He is 64 years old with no income, disappointed with the GPS government's action led by Abg Jo for not giving enough time for the rural people to exchange the cylinders when the gov announce on last year Nov and start operate in on Dec.

Akik Migi want the GPS gov give the people a chance to exchange the yellow LPG to Petros and if possible, deliver it to the rural people so that all the people can exchange their gas cylinders.

Please Abg Jo, be more sympathetic towards the people – Akik Migi urged.

On Nov 21, minister of utilities and telecommunications Julaihi Narawi announced in the Sarawak Legislative Assembly, that the state government had decided not to renew the LPG distrubtion license of MyGaz, giving Petros Naga control of 100% of the LPG market from Dec 1. Since then it bring chaotic situation in the market and caused public dissatisfaction, when owners of yellow cylinders couldn’t exchange them for red ones, as dealers and distributor were refusing to accept them to avoid incurring a loss of RM200 for each yellow cylinder.

Roderick Wong, DAP Senator of Sarikei Sarawak

*Pressure Mounts on Government to Solve Sarawak's Gas Cylinder Exchange*

Today, after receiving a call from the Sarikei community regarding the yellow gas cylinders issue, RFS contacted Senator Roderick Wong from Sarikei to convey the people's problems. Senator Roderick Wong did not deny this issue and he had received complaints before the last Chinese New Year. Senator Roderick Wong had brought the people's complaints to Petros Sarawak and the Sarawak Government to resolve the people's problems, but until now there has been no response from Petros developers and the Sarawak Premier's office.

The senator promised to urge the government to act quickly and also to the consumer cooperative so that the issue of exchanging yellow cylinders for Petros can be resolved as soon as possible.

    -----------------------------

Muhammad Faisal Abdul Aziz, Chairman of BERSIH 2.0

*Submitting a memorandum to parliament to demand reform, Bersih is a pro-people organization*

The march to parliament by BERSIH 2.0 this morning went smoothly and got cooperation from the police. A total of 6 members of parliament from Parti MUDA, PKR and PAS came and received a memorandum of 10 demands by BERSIH 2.0.

Faisal was a bit disappointed because Prime Minister Anwar Ibrahim did not come to welcome the gathering, but they are still looking for an opportunity to submit this memorandum to PMX Anwar Ibrahim.

The memorandum demands fair and clean elections, a moratorium on DNAA to cases of corruption and abuse of power and the separation of the jurisdiction of the attorney general and prosecutor.

Responding to the PAS deputy president's claim that the organization of the BERSIH 2.0 march to demand 100 percent Reform is a sign of protest by the people and NGOs who are not satisfied with Anwar Ibrahim's administration. NGO BERSIH 2.0 which used to be pro to PH, has now risen against them. PAS Head of Information Ahmad Fadhli Shari commented that the BERSIH 2.0 protests showed that the government was talking nothing about reforms.

However, according to Fasal, the PAS leader's claim is not true. BERSIH 2.0 is pro people, pro democracy and does not favor any political party.

Faisal said - when the government is slow to reform, we act urgently and the opposition party should also do the same. In the memorandum- we also insist on the fair implementation of the law. No favoritism and no double standards. Najib for example was given amnesty. What about the fate of other prisoners whose cases were not discussed by the pardon board. We demand that parliament discuss our demands and lay down a reasonable timeline for their implementation.

    -----------------------------

    Nicholas Mujah, Secretary-General of SADIA

*Do not be swayed by Abg Jo's friendliness, emphasizing the importance of political will in restoring indigenous rights*

With Taib gone, the question remains whether Abang Jo will respect native land rights. Nicholas Mujah, Secretary-General of SADIA, believes that Abg Jo can understand the plight of the indigenous people, especially regarding land issues under Tun Taib's rule. However, Mujah emphasizes that without outspoken Dayak voices, Abg Jo's administration may not prioritize changes, including restoring indigenous rights.

Mujah suggests that indigenous people must provide sufficient evidence, especially in cases related to Native Customary Rights (NCR) land claims, to bring to court. He stresses that if landowners are not courageous enough to speak up, their efforts might be in vain. Mujah advises against relying solely on social media and newspapers for exposure, advocating instead for legal action as the most effective approach.

Additionally, Mujah warns against being swayed by Abg Jo's friendliness, emphasizing the importance of political will in restoring indigenous rights. The challenge ahead lies in whether Abg Jo's administration will indeed address these pressing issues now that Taib is no longer in power.

    --------------------------------

Sailisah of kpg Andab Bangau Kudat, Sabah

*Join the Movement: Save Bangau Beach and its Ecosystem*

The communities of Kampung Andah Bangau are urging the public to sign a petition on change.org titled "Save Bangau Beach Kudat, Sabah" to help them voice out and protect the environment.

Sailisah, a fifth-generation resident of Kampung Andab Bangau in Kudat, Sabah, was one of two women charged with trespassing into the area operated by Kibing company for silica sand mining in the village.

Before the mining activities, Sailisah and the community ran an eco-tourism initiative with huts along the beach for visitors. They also cultivated vegetables and harvested seafood, including cuttlefish, prawns, fish, and snails. The area is also home to mangrove trees.

Since the start of the mining operations by Kibing company, the river and beach have become polluted and hazardous, with uneven sands, leading to a decrease in visitors. During Sailisah's arrest, which happened while she was clearing around the huts, the company blocked the access road to their huts.

The community's livelihood relies heavily on fishing, and the beach serves as a landing area for turtles. Despite the challenges, the beach has been designated as an eco-tourism area. Sailisah remained calm during her arrest, knowing she has the right to defend her eco-tourism area.

WWF-Malaysia has cautioned the state to proceed with caution in developing the area, stating that the silica sand mining project will negatively impact surrounding communities. The environmental watchdog group highlighted that the processing site will produce fine silica dust particles, which are hazardous to human health with long-term exposure.

*Bersih Rally Demands Reform: Peaceful Gathering Outside Parliament Tomorrow*

BERSIH 2.0 will hold a march to parliament tomorrow in order to remind the government about the reforms they promised must be implemented 100% and without delay.

Faizal said, Bersih along with other NGOs, demand that the government set a clear timeline and target for the implementation of the reform agenda. They admit that there is a bit of reform but it is very slow, reforms that should be expedited without delay are the Electoral Reforms, especially regarding the appointment of EC chairpersons and EC members so that the appointments are discussed in parliament. EC reports should be transparently presented and debated in parliament. In addition, the issue of separation of powers between the attorney general and the prosecutor is also very urgent and we demand a moratorium on the granting of DNAA by the attorney general to cases of corruption and abuse of power.

At the same time, the Kuala Lumpur Police chief reminded the public not to participate in parades/gatherings without a permit. However, according to Faizal, such a peaceful assembly does not require a permit. Just a notification to the Police authorities.

Today Faizal have met and informed the Police that the peaceful assembly will be held tomorrow. For now, 2 PH parliamentarians (YB Hassan Karim and YB Mohammed Taufiq Johari) have agreed to march together.

Bersih will submit a memorandum to the government and will hold a press conference. Bersih request that all Malaysians come together in a peaceful assembly to urge the government to implement 100% reform without delay.

*Nenggiri Dam Sparks Protests: Orang Asli Communities Unite Against Submergence*

Critics remain unconvinced by proponents' repeated assurances that only three Orang Asli villages will be permanently impacted by the Nenggiri Hydroelectric Dam in Gua Musang. Even those whose villages are not expected to be submerged remain skeptical.

Nora and her team persist in their protest against the dam, which threatens to submerge three Orang Asli villages. Nora, though her village is not directly affected, anticipates long-term issues such as climate change and flooding, given her village's lower elevation. She recalls severe flooding in 2014, exacerbated by extensive logging in the upper areas. The dam's construction is expected to worsen flooding, affecting villages like Pos Tohoi and Kuala Wias. The affected villages have not yet been relocated, and while half of the communities have agreed to relocation, the other half remain opposed.

The Nenggiri River is home to hundreds of settlements across eight zones, including Wias, Pasik, Gob, Simpor, Tohoi, Bihai, Angkek, and Depak. Three villages - Pos Pulat, Pos Tohoi, and Kampung Kuala Wias - are slated to be fully submerged when the dam is operational in 2027. This will displace 1,200 Orang Asli, who have been promised housing in new villages as compensation.

Grassroots activists estimate that around 3,000 Orang Asli, primarily from the Temiar tribe, are actively opposing the dam's construction, which began in early 2022.

    ----------------------------------

    Madam Agnes from Dijih Selangau

*Land Victory: Madam Agnes Wins Case After 16-Year Legal Struggle*

Madam Agnes has successfully reclaimed her land after 16 years of legal battles. In 2008, Agnes began the legal proceedings, and this year, 2024, she won the case for 1.2 hectares out of her 4.3-hectare land. Agnes stated that initially, her village engaged in a joint venture with Pelita to operate an oil palm plantation. However, she refused to participate because she knew that once involved in the so-called cooperation, the land would not be returned.

Nevertheless, one day in 2008, when she went to harvest her land, she was stopped by Palm Raya Plantation, who claimed the land was theirs. Agnes investigated and discovered that Pelita Holding quietly transferred her rights to her land in Lot 804 to the Palm Raya Plantation Company, which prompted Agnes to fight for her NCR land rights.

For Agnes, this is a victory, demonstrating that if one does not succumb to deceptive joint ventures or unfriendly development, it is possible to reclaim land, even though it may take a long time.

    1. The visit of 40 members of the Sarawak state assembly to the UK is only a waste of the people's money. Dun Sarawak is an example of democratic failure when the annual budget was passed with limited debate, the problems of the indigenous population failed to be addressed and authoritarian administration for more than 50 years.

    2. The fall in the value of the ringgit does not affect investment in Malaysia, said Prime Minister Anwar Ibrahim. It is not the same as in 1998. Malaysian inflation remains low, unemployment is down, investment is up and economic growth is competitive.

    3. 5G users in Malaysia will increase by 2400% percent from 404,323 in 2022 to 10,068,858 in 2024. But the rural internet and telephone service is so sad. The rural residents appealed to YB Minister to provide at least every longhouse in Sarawak with telecommunication service.

    --------------------------

Jeffery Ngui, Chairman of Sarawak MUDA

*The Need for Improved Telecommunications Services in Rural Areas: A Call for Government Action*

On 17 Jan 2024, Sarawak Utilities and Telecommunications Minister, Julaihi Narawi said that Internet access in Sarawak reached 78.8% at the end of last year 2023 and Sarawak is confident that it will reach 100% Internet coverage in 2030.

Although realistic with the government's target, with close cooperation between the state and federal government, several obstacles caused internet and telecommunication services to be interrupted. Among them are geographical challenges, weather, electricity/battery and satellite outages. Therefore, the TELCO and the government should provide a more systematic reporting system when downtime occurs.

Currently, there is no responsible party to explain to users why there is a disruption and when the service will be restored. Why are telecommunications services not developed quickly in rural areas? Jeffrery comment that, the reason is that the TELCO is too profit-based. Less populated areas, no TELCO company wants to build telecommunications infrastructure there.

In this context, according to Jeffery, the government should play a role. The government should certify that telecommunication services are a basic need and should be provided to all citizens regardless of location. The cost of telecommunication services should be given a low price for rural and poor communities. If the cost of building a tower and fiber optic is too expensive, direct internet services from satellite are an option - such as Starlink and Connectme Now. All types of communication technology should be explored to enable rural people to get internet services.

*Coastal Communities Under Pressure: Trespassing Charges and Environmental Impact*

Madam Iza and Madam Sailisah, residents of Kpg Andab Bangau in Kudat, were charged with trespassing in the Magistrate Court. They were apprehended by the police while clearing their huts at the beach, their main source of income for activities like fishing, on 16 May 2023 around 12:45 am. Their statements were taken until midnight. The community of Kpg Andab Bangau has been residing in that area for seven generations.

Their first court appearance was in June 2023, and later Ghalus Athoi helped them secure the services of Lawyer Datuk Ram Singh. Yesterday marked the final hearing of their case, where the court decided to discharge them without acquittal.

The presence of a company conducting silica sand mining activities has made Madam Iza and other women feel unsafe and has led to food insecurity, as the beach is now polluted.

Recently, Barnie Lasimbang highlighted to Radio Free Sarawak (RFS) that there is no publicly available Environmental Impact Assessment (EIA) report for the approval of SBH Kibing operations in Pantai Andab Bangau, Kudat. This is concerning as the operations are located near and discharge water into the fragile ecosystem of Tun Mustapha Marine Park, a fully protected Marine area. He only realized this lack of documentation when plotting GPS coordinates taken during a fact-finding mission. This issue is significant, as it could severely impact the environment and the tourism industry. Immediate answers are demanded from the government regarding this matter.

Bruce Yee, PKR of Sarikea Sarawak

*Citizenship Rights Struggle: Three Generation without MyKad in Sarawak*

Bruce Yee, a prominent advocate for citizenship rights, met with a family facing longstanding issues with citizenship documents. The family, comprising four members spanning three generations, has been grappling with this challenge for nearly 60 years.

Their journey to resolve these issues led them from Bintulu to Lubok Antu, covering a round trip of almost 900km. Their sole purpose was to confirm the schedule of the upcoming Special Citizenship Task Force (PPK) to be held at the Lubok Antu Community Hall from 26/2/2024 to 28/2/2024.

During a stop in Sarikei, they sought counsel from Bruce Yee, who emphasized the importance of perseverance in navigating the bureaucratic process to obtain citizenship documents. He encouraged individuals facing similar challenges not to lose hope despite encountering repeated setbacks over the years.

Bruce Yee also underscored the significance of families maintaining communication with district offices to stay informed about PPK schedules in their respective areas. The PPK initiative, a collaborative effort between the Ministry of Home Affairs and the State Government, aims to assist Sarawak-born individuals in acquiring citizenship documents promptly.

The PPK team will continue its presence in various district areas across Sarawak until the end of the year. Bruce Yee urged affected individuals to seize this opportunity and engage with the PPK team or the National Registration Department (JPN) for document-related assistance.

Bruce Yee’s advocacy comes at a crucial time, as many in Sarawak, including elderly citizens, still lack essential documents such as MyKad. He and PKR Sarawak efforts have drawn attention to the need for comprehensive solutions to address citizenship issues and ensure equitable access to citizenship rights.

    1. Taib Mahmud was buried at the family cemetery in Demak Jaya at 2.20 this afternoon. The people of Sarawak mourned for 2 days starting yesterday.

    2. BMF urges the Malaysian government to immediately freeze Taib Mahmud's assets and reopen the investigation into Taib's alleged misuse of power and violation of constitutional provisions while being chief minister and TYT.

    3. Muhyiddin Yassin's son-in-law who fled a year ago will be charged with breach of trust. According to the chief commissioner of MACC - the investigation papers against Muhammad Adlan have been completed and are ready to be accused in court.

    4. Taib failed to bring progress to the penan area, according to village head Mutang Tuo. Dozens of Penan villages have no infrastructure facilities and the Penan people live in poverty. It's getting harder and harder for us to live because our land and forests are confiscated. All this happened since Taib became the chief minister of Sarawak.

    -------------------------------

TK. Mutang Tuo, Head of Long Iman Penan Village, Mulu.

*Taib failed to bring development to the Penan area*

Today I just heard the news that the former chief minister of Sarawak Taib Mahmud has died - Mutang said.

Mutang comment that, all parties praised Taib for bringing progress to Sarawak. That may be true for people in the city, but for penans, Taib failed to bring development in their area. In fact, Taib and his cronies, they seized Penan forests and land.

Mutang felt sad that the river is broken. There is no telephone service in his longhouse in Long Iman. When the RFS spoke him, he is fortunate to be on a hill in his paddy field. In his village, there is 100% no telephone line. Therefore he think Taib has failed to advance penan.

Penan ask for paved roads, house building projects and rights to NCR land so Penan can move forward. But what the government builds, are Dam. They are not proposing the construction of the Tutoh dam, but this is what GPS and Sarawak Premier Abang Johari want to build.

Dozens of penan settlements are hoping for roads, clean water supply and electricity. But until now Penan have not been given the project as we requested. It is often mentioned by the government that Penan is the golden child of the government. But why are basic infrastructural facilities not built in Penan area? - Mutang Tuo asked.

Others will say that Taib succeeded in bringing development. But for penans, he failed. He failed to bring prosperity in the Penan area.

    Paul Nunggang from Baram

*Taib Mahmud's Impact on Orang Ulu NCR Land Rights: All about Exploitation*

Paul Nunggang comment that Taib Mahmud did not do much to help the indigenous people, especially those living in the interior, because what Taib did was to grab the native customary rights (NCR) land of the indigenous people in Sarawak. Taib, being a lawyer by profession, has amended many NCR land laws, which has led to many cases of encroachment by his cronies on NCR land. Taib's power has also not recognized the rights of the indigenous people to their ancestral land. This has greatly inconvenienced the people and does not recognize the rights of the indigenous people to land ownership.

    -------------------------------

    Mark Bujang, land mapping expertise

*Empowering Communities: NGOs Push for NCR Land Surveying without compromising land rights*

In today's news, Ibans in Serian were advised by Sarawak Deputy Premier Amar Douglas Uggah Embas to use the Dayak Bidayuh National Association’s (DBNA) module for surveying their native customary rights (NCR) land. During a meeting with Iban community leaders from Serian, Uggah emphasized that landowners should take the lead as surveyors, identifying their land boundaries. Mark Bujang, a land mapping expert, viewed this as a positive step, noting the importance of communities conducting their own land surveys, although he is not familiar with the specifics of the DBNA module.

However, Mark Bujang questioned why the government has not introduced GPS to all communities and NGOs, considering its widespread use in Sarawak and globally. He raised concerns about the government challenging community maps and not recognizing surveys conducted by him and other NGOs, despite their efforts to assist communities with land surveys. Bujang questioned whether this lack of recognition is due to communities not being registered with the Land and Survey department, and he emphasized that this should not invalidate their surveys.

Mark Bujang and NGOs conduct workshop training on GPS and GIS before conducting ground surveys, and they also consult with communities on their boundaries. He expressed a desire for clarity on the differences between their approach and the DBNA module, and he urged land surveyors to explain and introduce a module that the government recognizes, without compromising land rights.

    1. Taib Mahmud died at the age of 87. The people of Sarawak mourned for 2 days.

    2. The case of 9 longhouses vs TH Pelita Simunjan Sdn.Bhd has been postponed to March 14, 2024. Residents remain in blockade until they know the court's decision.

    3. Najib Razak is a criminal and the main planner of the 1MDB scandal. He should be held accountable for the crimes he committed. The people should not believe the narrative popularized by Najib and his team, that Najib is innocent, Najib is the victim in the 1MDB case and Najib should be released and get a full pardon.

    --------------------

Iswardy Morni, Lawyer Activist and Political Analyst

*No More Attempts at Pardon: Guilty is Guilty*

Najib Razak's main lawyer Mohd Shafee Abdullah is getting louder and bolder in fighting for Najib's release. Najib and Shafee build a Narrative that Najib is innocent, Najib is a victim of persecution in the 1MDB case and Najib deserves an immediate pardon. In the "Reform of the National Pardon System" Forum - Shafee said that the court failed to give Najib a fair trial including during the appeal process. In fact, Shafee quoted Najib's words - "I have the right to amnesty from day one, and I don't even need to go to jail, even for a day".

Iswardy advised Shafee to accept the fact that Najib is guilty and has already been proven guilty through a long trial (over 4 years) through 3 levels of court). In the long trial, Najib's legal team failed to raise reasonable doubt. So the judge found Najib guilty. When making such comments, Shafee can be accused of contempt of court. Why are Najib and Shafee so brave? According to Iswardy- the movement to free Najib through UMNO is gaining momentum. In the past, PH, which strongly attacked Najib, now does not speak out because it wants to maintain unity in the unity government. Making Anwar look weak. Iswardy insists that Najib is a criminal, he is a prisoner. He can apply for forgiveness but it is not Najib's absolute.

Asked whether the AG and provincial ministers should be on the Pardon Board because they are appointed on the advice of the Prime Minister. That is the requirement of article 42(11) of the federal constitution - Iswardy said. Iswardy advised the people to give a strong mandate to PH and Anwar in GE16. With the big victory of GPS and UMNO, it is no longer needed, so there is no pressure from GPS and UMNO on PMX.

Denis Along, land rights activist from Mulu

*Taib's Achievements and the Ongoing Land Disputes*

Today, Taib has passed away. Denis believes that Taib's achievement of serving the longest tenure as Chief Minister and Governor of Sarawak was truly remarkable, but it discriminated against the Dayaks. Since Taib came to power, the Dayaks have lost their Native Customary Rights (NCR) land. Taib benefited from policies created by his uncle, Tun Abdul Rahman. Their achievements are highly impressive, but the Dayaks have suffered as a result. Taib's contributions to politics have also led to discrimination against the majority in terms of education, job opportunities, development, and more. Both Taib and Tun Rahman have left a tyrannical legacy. Denis feels that discrimination is pervasive in every aspect of life.

    Mr. George from Uma Akeh

*Road Construction Neglects Maintenance: Inland Communities Left Isolated*

George also share his opinion about the RM729 million development project that was approved in 2018 for the Telang Usan constituency.

According to George, there were indeed projects implemented, especially for upgrading roads. However, the quality of the roads built did not meet the allocated budget. The roads are now deteriorating and no longer monitored. Dangerous roads along the hillsides were not equipped with barriers for the safety of road users. Since 2019, no road upgrading has been carried out. This is why when it comes to projects aimed at winning votes, it's just a drama of development projects. Abang Jo once said, "If the elected representative does not work, remove them." Mr. George described this statement as just political theatrics by GPS. Unfortunately, people in the interior areas still want to vote for a political party like GPS, which continues to deceive the people.

Today the Kuching High Court is sitting to hear the case of Residents of 9 Long Houses in Ruan Simunjan suing TH- Tabung Haji Pelita Simunjang Sdn.Bhd. However, because there is a court order that has been issued in advance for the residents to open the blockade that was set up. So both parties agreed that the case related to the court order should be heard on 28 Feb 2024. Combined with the court case that is currently being heard. So the court made a ruling that the case will be heard again on March 14, 2024. Residents in the 9 longhouses that were blockaded continued their activities as usual. Lawyer Dominic Ng represents the residents of 9 Longhouses.

    1. 9 Long houses in Ruan Simunjan dragged Tabung Haji Pelita Simunjan Sdn.Bhd to court - for allegedly cheating in a joint venture to develop a palm oil plantation on the residents' NCR land. In fact, residents have been suing Tabung Haji since 2013, but their cases are often delayed. However, TH Pelita Simunjan brought the case to court on February 28, 2024 because the residents held a blockade to prevent the harvesting of palm oil from the Semalatong Farm.

    2. Najib's lawyer Shafee Abdullah demanded that all documents obtained from Hong Kong and Switzerland through mutual legal assistance (MLA) be shared with the defense team. However, MACC Senior Superintendent Nur Aida Arifin disagreed because not all of the documents were relevant. Najib faces 4 charges of using his position to obtain bribes of RM2.3 billion and 21 charges of money laundering with the same amount.

*Villagers' 2013 Lawsuit Against TH: Court Date Rescheduled for Tomorrow*

    Blockade 3rd Week Update.

This week marks the 3rd week for the residents of 9 longhouses in Ruan, Simunjan to hold a blockade to prevent the company TH- Tabung Haji from taking out palm oil from the Semalatong Farm. Semalatong Farm is a farm cultivated by TH as a result of cooperation with developing NCR land of local residents. However, when the oil palm produced the results, TH refused to hand over the profits of the plantation to the people who own the land. When investigated in detail. Apparently TH cheated the residents by taking their land but included the names of other people (who did not own the land) in the agreement document. Residents have taken the case to court since 2013 and the case has been postponed several times at TH's request.

However - tomorrow (February 21, 2024), at 9.00 am - according to TR. Mini ak Ringkai this case will be tried at the Kuching high court.

We hope there will be no more delays this time, said TR. Mini ak Ringkai. Lawyer Dominic Ng will represent the residents. On the other hand, on February 28, 2024, TH will sue the residents for holding a blockade. It is understood that TH has obtained a court order to ask residents to lower their blockade. Therefore, the court will hear the arguments of both sides. Although the case will be heard in court, we will continue the blockade - Said Tr. Mini ak Ringkai.

Nick Kelesau, Penan activist from Ulu Baram

*Transparency Demanded in Sarawak Development Projects Allocation*

A post recently circulated on social media regarding the Borneo Post article dated 30th November 2018, stating that YB Dennis Ngau allocated RM 729 million for development projects approved by the Sarawak Government for the Telang Usan area to be implemented in 2019. The projects include 16 initiatives, with 8 aimed at upgrading existing roads to R1 standard and 8 for clean water supply.

One of the projects involves RM 10 million for clean water supply in Long Kevok, including a water intake and treatment plant, high-level tank, water booster station, and RM 5 million for building a single-lane iron bridge in Long Kevok, Sg. Layun. However, Nick Kelesau, a Penan community leader, stated that there is no visible iron bridge in Long Kevok, raising questions about the utilization of the RM 5 million.

He acknowledged repairs to roads within the village but noted that the condition of the main road outside the village, particularly in Ulu Baram, is poor, worsened during rainy seasons. Kelesau questioned whether the 2018 project budget announced by Dennis Ngau was utilized effectively and demanded transparency regarding all project details, including the amount spent and the parties involved. This transparency, he argued, would enable villagers to monitor and ensure the successful completion of projects for comprehensive inland infrastructure development.

Jeffrery Ngui, Chairperson of Muda Sarawak

*No Interference Allowed: MUDA's Stance on Donor Influence*

On Daim, it is said that he is a godfather or the biggest funder of MUDA. Jeffrey's opinion is that this is not something new. MUDA has constantly been labeled as having big figures behind the scenes, including Tun Daim. His reaction to all these allegations is what the joke is about in today's headlines. Lately, there seems to be a planned attack against MUDA. Resignations from posts and quitting parties usually happen in every party, but when it happens in MUDA, it becomes a headline.

On Naimah, it was exposed that she is a member of MUDA and is said to be close to Syaid Sadiq, YB Ameera. This is not true, but we cannot stop anyone from joining the party. There is no endorsement, no scrutiny needed. They want to clear up a wall of load practice. Until they want to become leadership, then they will undergo some tests.

On funding issues, there is a limit of only RM200,000. Usually, MUDA goes for crowdfunding for any events. For those who donate in large amounts, they must also comply with party policy, which means they must not interfere with MUDA's principles. They cannot make any deals related to donations.

Regarding Daim's case, investigations must be done.

    1. The prison sentence against Clare Brown is politically motivated and intended to intimidate other parties into not daring to speak out.

    2. YB Gerawat Gala refused to meet with NGOs and residents' representatives. Just send a representative. Prof Wong Chin Huat, Academician and Political Analyst

*Malaysians Should Support and Rally Behind Clare, Because Justice is Universal*

Prof Wong discussed the impact of the 2-year prison sentence on Clare Brown by the Kuala Terengganu Magistrate's court. Of course it puts pressure on Clare but more unfortunately it scares others and makes them afraid to speak up.

In this case, Clare was trialed by two courts. First the court of public opinion and second of course the civil court that tried Clare. It would be unfair to sentence Clare without a full trial (in absentia) or Clare not being given a chance to defend herself.

First the case was filed in the high court in Kuala Lumpur then transferred to Terengganu, where the plaintiff got the upper hand. It would be unfair for Clare to be punished for writing a paragraph that really only needs corrective action. The sentence handed down against Clare sparked an international reaction. The court of public opinion began to question what the Madani government was doing. 1MDB offenders and criminals Najib Razak were given a half amnesty and fines were discounted by 76%, but the main informant of the 1MDB scandal was sentenced to 2 years in prison. Like it or not Madani government should act decisively. In the event of an abuse of court process in the Clare Brown case. So strict action should be imposed on the negligent party. Wong Chin Huat is convinced that there is a political motive in the prosecution of Clare. However - Wong asked that Malaysians do not hesitate to support Clare's actions and efforts, even though she is a foreigner. Justice is universal - Said Prof Wong. It doesn't matter if she is a stranger, as long as she is fair and does the right thing. So her action should be supported. Even local Malaysians, if robbing and corruption. So all Malaysians should reject and oppose.

*Over 600 Tutoh Village Residents Express Anti-Dam Sentiment, Yet Gerawat Sends Only Aide for Discussions*

Dennis and friends were disappointed when Gerawat Gala (GPS) Mulu assemblyman - was too busy and could not spare time to meet them as promised (17 Feb 2024).

Gerawat gave the reason that he had more important and unavoidable meetings and commitments, only sent his secretary, Mr. Simon Julie Lugun to meet anti-dam activists.

Dennis and friends submitted a petition of 600 Tutoh residents protesting against the proposed construction of the Tutoh dam. Dennis and friends explained that he is not anti-development.

We are only against the construction of the dam, against the sec 6 land measurement and against the TPA policy of increasing the area of Taman Negara Mulu. We want roads, electricity and clean water. We are only against projects that destroy the environment- Said Dennis Along.

    -----------------------------------------

Mr. James from Tradition Village Usahajaya Tukau Miri

*Tradition Village Residents Stand Firm: No Relocation Without Full Compensation for Homes and Crop*

Mr Janmes confirms that the villagers have received a letter from the land and survey department stating that the Parabena company has agreed to provide a relocation scheme by helping to fill in the land with low fertility to ease the burden on the villagers. This is to avoid them having to fill in the land themselves for the purpose of rebuilding their homes after they leave Tradition Village Usahajaya Tukau. However, according to Mr. James, they will not move as long as the government or any relevant department involved in the eviction of the Tradition Village Usahajaya Tukau Miri community does not fully compensate them for the loss of their homes and all the crops that have yielded results for them.

According to a statement from the land and survey office, the entire community there is said to be squatters, and this disappoints Mr. James as the rights of the people are being undermined by the land and survey department. If they were squatters, why is there 24-hour electricity and plots from the land and survey office have also been given for over 30 years, with some having lived in the village since the 1940s.

Once again, Mr. James explains that as long as the compensation they demand is not fulfilled, no community eviction can take place.

*Local Community Discontent: Chinese Company's Silica Sand Mining Project in Kudat*

A fact-finding mission was conducted in Pkg Andab Bangau, Kudat, regarding silica sand mining by a Chinese company. The project was supposed to provide job opportunities for local communities, but it was found that most workers were Chinese nationals, with only 2 or 3 locals supporting the mining project. Silica sand is a primary material for solar panels.

Barnie and his team discovered that the water surrounding the area is now polluted. While the water used to be clear, it is now the color of coffee. Additionally, the team learned that two local women were charged in a Sabah Magistrate's Court for trespassing into the factory. Simultaneously, the communities are claiming their Native Customary Rights (NRC) to the area for their livelihoods. Since the mining operation began, their access road has been blocked. However, the charges against the two women were dropped.

The company is avoiding disclosing their Environmental Impact Assessment (EIA) report.

    1. The blockade by 9 villages in Ruan, Simunjan continues even though TH has obtained a court order for eviction. 11 years ago Tabung Haji TH has conducted a joint venture with 9 villages involved in oil palm cultivation. But when the Palm oil yields. TH refused to share the profits with the residents. We are ready to face the authorities and we also dare to face TH in court - said Tr. Mini ak Ringkai.

    2. The possibility of Clare Brown being extradited to Malaysia will not happen. Such is the view of Lawyer Ngeow Chow Ying. This is because Malaysia and the UK do not have a treaty related to extradition. On Feb 7, Clare was sentenced to 2 years in prison by the Kuala Terengganu Magistrate's Court for allegedly defaming Sultanah Nur Zahirah. Chaw Yin is convinced that the prosecution of Clare is politically motivated. According to Chaw Yin, Book - The Sarawak Report - The Inside story of 1MDB expose. Key clues to the 1MDB case

Ngeow Chow Ying, Lawyer and legal practitioner

*Justice Denied: The Political Persecution of Clare Rewcastle Brown*

Clare Rewcastle Brown (CRB) was sentenced to 2 years in prison by Magistrate Nik Mohd Tarmizie Nik Mohd Shukri after the Kuala Terengganu Magistrate's Court heard and heard the case of Sultanah Terengganu Nur Zahirah's Defamation Suit against CRB. CRB was accused of slandering the Sultanah of Terengganu in his book The Sarawak Report "The Inside Story of 1MDB expose". Is the judgment valid?

Ngeow thinks there are clear doubts that the trial conducted was unfair. In any court case, those accused should be given space to defend themselves. In this case, CRB was not informed of the charges against her and her lawyer who was in Kuala Lumpur was also not informed. This leads to doubts about the validity of the sentence imposed.

Of course there is an argument that states that section 425A of the Criminal Procedure Code allows the trial to be conducted in absentia or without the presence of the accused. But according to Ngeow, this section only applies to trials that have started and halfway through the accused has refused to appear in court. This is different from the CRB case that she was not informed from the beginning. Section 425A was only included in the criminal procedure code in 2016 and should not be misused.

Is there a remedy to correct this error? Ngeow believes that Clare's lawyers have filed an appeal and there is indeed a chance for Clare to defend herself. However Ngeow is convinced that the prosecution of Clare is politically motivated. Since CRB has written a book that opened the eyes of all Malaysians and the world regarding the 1MDB scandal - the world's biggest financial scandal.

Will Malaysia request that Interpol arrest and extradite CRB so that he can serve his sentence in Malaysia? and will Interpol obey without question to follow the wishes of Malaysian courts? Ngeow said that there is no treaty/cooperation/agreement between Malaysia and the UK regarding extradition. Under the UK extradition act - the person to be extradited must have committed an offense under UK law. If there is no treaty between Malaysia and the UK, then Interpol will not be able to act.

*Defending Community Land: The Fight Against Corporate Greed*

Tr. Mini explained that until now no police or Semelatong Farm authorities have come to evict them. Although yesterday they were told by their lawyer Dominic Ng that TH Tabung Haji had obtained a court order to evict them from the blockade site.

Tr. Mini raised the question is how dare they evict the community, this is the community’s land, not TH's Haji Fund land.

The land area of 9 villages that was fraudulently taken by TH is more than 2000 hectares. Tr. Mini said the community has made a police report since the first day their land was invaded and they have also sued the parties involved in court. But they always failed to appear in court so the trial could not be conducted.

The Community hope that the court will make a decision to return community land along with compensation for losses.

*Generations of Cultivation: The Battle for Kantan Farmers' Land*

On the eviction of Kantan farmers in the Tambun constituency, which is represented by a Member of Parliament Anwar, these farmers, who are now in their fourth generation occupying the area, have been cultivating it since before the Second World War.

These farmers are responsible for supplying food to the surrounding areas as well as to mining workers. During the state of emergency in those days, they were evacuated to Kampung Baru but were allowed to continue their farming activities during the day to meet essential needs.

They continue to reside in Kampung Baru. These farmers have applied for land titles and so forth, but the Perak State policy is not to grant titles to this group. Even to this date, the majority have not received titles.

There are about 400 farmers here who can produce 40 tonnes of fruits and vegetables daily. This is the main area for supplying essential products.

What has happened now is that PKNP has been allocated over 700 acres by the Perak state government. PKNP is one of the GLCs, in which the Chairman is the Menteri Besar. Among all the farmers, 7 farmers were evicted.

The farmers have tried to bring up the issue in court, claiming that they were promised other land. However, this promise has yet to materialize. So, the farmers are applying for the eviction to be suspended until their land is replaced.

*Challenges of Political Alignment in Rural Communities*

Agnes commented on the statement by the Bukit Begunan assemblyman, Mong Dagang, who called on the Village Development and Security Committee (JKKK) to act as a bridge between the people and the government. However, according to Agnes, political differences in longhouses have greatly caused disunity among the community, especially in the distribution of government development projects where there are still those who practice favoritism towards the people who support the opposition. Usually, those who oppose are often marginalized from receiving any form of development assistance from the government. For example, a few years ago, the village head who supported the ruling party (which was then BN before changing to the GPS brand) divorced his wife because she strongly opposed and supported the opposition party, which should not have happened.

Ms. Agnes calls for the people under the Unity government led by PMX to practice unity towards each other for the sake of mutual harmony.
